General Terms and Conditions (GTC) and Data Protection Declaration of Sauna Boats Genève (Ginevra Film Murgia)
1 Scope of application
We recommend that you read the following General Terms and Conditions carefully. These General Terms and Conditions (“GTC”) apply without explicit individual agreement to the contrary to all contractual relationships between the tenants (and their guests) and Sauna Boats Genève (Ginevra Film Murgia) (hereinafter also referred to as the “Landlord”).
General contractual terms and conditions of the Lessee which deviate from these GTC shall only be applicable if they are expressly recognised in writing by the Lessor.
The terms reservation or reserving (or similar) are at all times to be equated with booking or reserving (or similar). The same applies to the terms rental object and rental boat.
2 Recognition
The tenant expressly accepts the General Terms and Conditions as an integral part of the tenancy agreement, in particular the liability for damage caused by the tenant to the rented property or to third party property, and ensures himself that he is properly informed about the handling of the rented property.
3 Start and end of the rental period
All rentals shall commence at the agreed location of the Lessor and shall end as soon as the rental object is delivered on time to the same location of the Lessor, unless otherwise agreed. The Lessor must be notified immediately if the Hirer is prevented from commencing the hire as well as in the event of an unforeseen extension of the hire. If the rented property is not returned after the agreed time, the hirer shall pay CHF 200 for each hour or part thereof. If this makes further letting of the rented property impossible, the tenant must compensate the full loss of use (see clause 12).
4 Change or cancellation of a booking/order
Changes or cancellations of a booking/order have to be communicated to Sauna Boats Genève (Ginevra Film Murgia) by e-mail and are only valid with their written consent. Decisive for the calculation of the cancellation date is the acknowledgement of the cancellation declaration by Sauna Boats Genève (Ginevra Film Murgia).
A rebooking to another Sauna Boats Genève (Ginevra Film Murgia) location (e.g. Zurich) is considered a new booking and the existing booking falls under the cancellation deadlines listed under points 4.1 and 4.2 with the corresponding costs.
4.1 Change or cancellation of a booked Sauna Boat slots
The tenant has the right to provide a substitute tenant at the conditions agreed with Sauna Boats Genève (Ginevra Film Murgia), if the tenant is prevented from taking up the booking.
If a booking/order is cancelled by the hirer, he/she shall bear the cancellation costs and the processing fees as follows.

4.2 Change or cancellation of a purchased voucher
If a purchased voucher is cancelled by the hirer, the hirer shall bear the cancellation costs and the processing fees as follows.

5 Authorisation to operate the rented property
The person who has signed the rental contract is liable as skipper for the rented object.
The hirer is fully liable for any traffic violations, etc. The hirer or skipper must be prepared to manoeuvre at all times. Several hirers may sign the hire contract and are then jointly and severally liable for the hired object.
The hirer or skipper must be of full age. Children and young people are the responsibility of their parents/guardians.
According to Art. 40a of the Inland Navigation Ordinance (SR 747.201.1), anyone with a blood alcohol level of over 0.5 per mille is not permitted to drive a sports or leisure vessel on Swiss waters. Furthermore, all persons involved in the navigation of the vessel must comply with this regulation.
6 Rental boat
The fuel and firewood provided are included in the rental price. The rented object is handed over in running order. The hirer or skipper undertakes to return the hired object in the same condition as when it was hired. Any soiling of the rented object is to be refrained from. In the event of excessive soiling, the additional cleaning costs of at least CHF 300 (deposit) will be charged to the hirer. Furthermore, the tenant remains personally liable for all additional cleaning costs not covered by the comprehensive liability insurance.
Cooking or heating of food is not permitted on the entire rented property.
Any explosive or flammable substances are prohibited on the rental property. This applies in particular to candles. Smoking is strictly prohibited on the entire rental property.
Animals are not allowed on the rental object.
7 Health risks
The use of the rental object is associated with risks. The tenant acknowledges that after the sauna, it is necessary to cool down with cold water before diving into the lake. The landlady points out that the bathing ladder must be used and that it is never allowed to jump directly into the lake. After cooling down, a rest period of 15 minutes is recommended. Use of the sauna is only permitted with a sufficiently large sauna towel. The oven door remains closed except when adding firewood. The landlady advises persons, especially those with cardiovascular problems, not to use the rented property. Sex on the rented property is not permitted.
The roof may not be entered under any circumstances.
Bathing with the engine running is expressly forbidden.
The lessor also accepts no liability for burns, drowning, injuries due to slipping, possible infections etc.
8 Duties in the event of an accident
In accordance with Art. 12 of the Inland Navigation Ordinance (SR 747.201.1), the hirer shall ensure that the names and addresses of the persons involved in the accident as well as witnesses are ascertained; all persons involved in the accident must make themselves available. The skipper shall render immediate assistance to persons or vessels in danger, insofar as this is compatible with the safety of his or her vessel. If people have been injured or killed or if people are missing, the police must be called immediately. In addition, the lessor must be informed immediately. Agreements with parties involved in the accident or third parties shall be of no relevance to the Lessor.
9 Third-party liability and fully comprehensive insurance
In the event of damage, the hirer must pay the lessor an amount of at least CHF 300 as a deductible and compensation.The lessor accepts no liability for damage to property or personal injury.The tenants and guests of the rented property are responsible for taking out appropriate accident/personal protection insurance themselves.
10 Damage to the rented boat
In the event of damage to the rented property, the hirer shall be liable for an amount of at least CHF 300 (deposit). Furthermore, the hirer remains personally liable for all damage not covered by the third party comprehensive insurance.
11 Loss of loose objects
In the event of loss of loose objects belonging to the lessor (keys, rain trowel, etc.), the tenant shall be liable for at least CHF 300 (deposit). Furthermore, the tenant remains personally liable for all damages not covered by the insurance (see clause 10).
The landlord accepts no liability for lost items belonging to the tenants.
12 Repairs
The tenant is obliged to inspect the rented property before commencement of the rental period. In the event of silence, it shall be assumed that the rental object is in a clean, faultless and roadworthy condition at the time of handover. The hirer shall be liable for any damage occurring during the rental period in accordance with points 9 and 10. Necessary repairs must always be carried out by a workshop designated by the lessor. No repairs or alterations may be made to the rented property without the Lessor’s consent. The tenant shall pay the landlord the full loss of use for the duration of any repairs.
13 Liability of the lessor
If the responsibility for a defect in the rented property does not lie with the tenant, the lessor shall not be liable for any damage or consequential damage.
14 Fulfilment of contract
In the event that the hired object cannot be made ready for use in the period between the conclusion of the contract and the commencement of the hire, the Lessor shall be entitled to withdraw from the contract. The hirer shall receive his money back or a voucher for a new date to the value of the booking made.
15 Weather dependency
In the event of uncertain weather or storm forecasts, the lessor reserves the right to allow saunas on the rented property only directly on the jetty, in which case a rent reduction of 30% of the basic boat rent without extras (picnic basket, drinks, laundry, etc.) will be offered. Alternatively, the hirer may cancel their booked date and receive a voucher for a new date to the value of the booking made.
The strong wind warning (orange flashing light which lights up approximately 40 times per minute) draws attention to the danger of strong winds (cf. Art. 40 Para. 1 of the Inland Navigation Ordinance (SR 747.201.1). The hirer or skipper must return the hired vessel to the location where the hire commenced.
The storm warning (orange flashing light which lights up approximately 90 times per minute) draws attention to the danger of strong winds (cf. Art. 40 Para. 2 of the Inland Navigation Ordinance (SR 747.201.1). In the event of a storm warning, the hirer or skipper is obliged to return immediately to the nearest port.
16 Conduct on the lake
The rules of conduct at the lake are governed by the Inland Navigation Ordinance (SR 747.201.1).
In particular, the following rules of conduct must be observed:
- Noise in the harbour area and near the shore must be avoided.
- Course vessels always have the right of way. The minimum distance to course vessels is 50 metres.
- Motor vessels may only enter the inner shore zone (0 to 150 metres) to moor or cast off, to anchor or to pass through narrow passages; they must take the shortest route. As a rule, this means taking the path at right angles to the shore. Parallel sailing to the shore is prohibited. Parallel sailing is only permitted in the outer shore zone (150 to 300 metres). When anchoring and taking a sauna, a distance of 50 metres from the shore must also be maintained. For noise reasons, saunas must not be taken in the vicinity of residents.
- When the boat is anchored, one person must always remain on board and be ready to manoeuvre.
- It is strictly prohibited to navigate in the transit zone, on commercial shipping lanes, or near the Mont-Blanc Bridge. Any violation will result in a fine in accordance with the navigation regulations for Lake Geneva.
Approaching or mooring to other boats is not allowed. Please maintain sufficient distance from other watercraft to avoid damage or hazards. - Docking and departing are permitted exclusively at the rental harbor. Other docking points may not be used.
- Any rule violation will result in a fine of CHF 500.00. If staff intervention is required due to a violation, an additional fee of CHF 80.00 will be charged.
17 Data protection
With the conclusion of the contract, the tenant accepts the processing of his personal data, in particular the exchange between Sauna Boats Genève (Ginevra Film Murgia) and third parties regarding all data of the tenant in connection with the rental of the rental object. This also applies in particular to the cooperation of the booking platforms and third parties who ensure the rental of the rental objects at the location of the rental start. Personal data shall only be collected, processed or used to the extent that it is necessary for the establishment, content or amendment of the legal relationship.
Furthermore, the tenant hereby acknowledges that the rental object is equipped with a tracking system for security purposes and that Sauna Boats Genève (Ginevra Film Murgia) is entitled to check where the rental object is located.
The renter acknowledges that data may be collected by the IT system when visiting the saunaboats-geneve.ch website. These are usually technical data, which are collected automatically, especially when visiting the website. The data of Sauna Boats Genève (Ginevra Film Murgia) are hosted by an external service provider, whereby all data can be stored on the servers of the host or third parties. The data protection compliant processing is guaranteed. This applies in particular to payment data, data from the contact form or newsletter, data from the registration on the website of Sauna Boats Genève (Ginevra Film Murgia), information from the comment function, etc. Data from web analysis services (Google, Facebook, MailChimp, YouTube etc.) are processed and stored in accordance with data protection.
The tenants are hereby expressly informed that data transmission on the internet (e.g. communication by e-mail) can have security gaps. Sauna Boats Genève (Ginevra Film Murgia), including Saunaboot GmbH, assumes no liability.

18 Supplementary provisions
The tenants confirm that they have read and understood the contents of the contract. They confirm that, for this purpose, they have received a translation of this contract in French.
In case of disputes arising from this contract, the German version of the contract shall prevail.
The Swiss Code of Obligations shall apply in addition to these provisions.
19 Place of jurisdiction
Genève is agreed as the exclusive place of jurisdiction for any disputes arising from this contract.
